7. Legal Terms
7.1. Return Abuse
Holley reserves the right to refuse returns, deny warranty service, or restrict future purchases for customers exhibiting patterns of return abuse, including but not limited to excessive return frequency relative to purchase history; return of products showing clear signs of use following the return window (“wardrobing”); repeated warranty claims for products outside warranty coverage; and misrepresentation of product condition at time of return. Decisions under this section are at Holley’s sole discretion. Customers will be notified in writing and may appeal to Customer Service.
7.2. Policy Changes
Holley reserves the right to modify, update, or replace this Policy at any time and in its sole discretion. The most current version will be posted at www.holley.com and will indicate its effective date.
The version of this Policy in effect at the time a product is purchased governs the return and warranty rights for that purchase. Modifications will not retroactively reduce the return or warranty rights applicable to products purchased before the effective date of the modification. By making a purchase after a modification takes effect, the customer agrees to the updated Policy then in effect; customers who do not agree to a modification should refrain from making purchases from Holley.
Holley will use reasonable efforts to provide notice of material changes through prominent posting on its website, by email to customers with active warranty claims or pending returns, or through other appropriate means.
7.3. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: HOLLEY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS OR INTERRUPTIONS. HOLLEY’S TOTAL LIABILITY RELATED TO RETURNED PRODUCTS SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE OF THE PRODUCT.
7.4. Exceptions
Any exception to this Policy:
• Must be approved in writing by Holley’s Vice President of Customer Service prior to return, and
• Will be evaluated on a case-by-case basis.
7.5. Governing Law and Dispute Resolution
This Policy and any dispute arising out of or relating to it shall be governed by the laws of the State of Tennessee, without regard to its conflict-of-laws principles. Customer and Holley agree to the exclusive jurisdiction of the state and federal courts located in Davidson County, Tennessee.
Informal resolution. Before initiating any formal proceeding, the customer agrees to contact Holley Customer Service in writing at [email protected] and to allow Holley at least thirty (30) days to attempt to resolve the dispute. Most disputes can be resolved through this process.
